The regulatory expectations facing financial institutions are changing. Regulators are increasingly looking beyond the existence of policies and procedures to assess whether firms can demonstrate that their compliance frameworks, governance arrangements, and risk controls are effective in practice.
Recent developments from the Financial Sector Conduct Authority (FSCA) and the Financial Intelligence Centre (FIC) point to increased supervisory scrutiny, greater reliance on regulatory reporting and data, and a growing focus on accountability and measurable compliance outcomes. At the same time, the Conduct of Financial Institutions (COFI) Bill continues to provide a clear indication of the future direction of conduct regulation in South Africa.
This webinar provides a practical update on significant regulatory developments affecting financial services providers (FSPs) and accountable institutions since our last Regulatory Update webinar in November 2025. It will also examine the emerging supervisory themes shaping regulatory expectations and what firms should be doing now to prepare.
Focus Area
The South African regulatory environment is moving towards a more supervision-driven approach in which regulators place greater emphasis on governance, risk management, compliance effectiveness, and the ability of firms to demonstrate positive outcomes.
Recent regulatory activity has highlighted:
- Increasing enforcement action and the use of administrative sanctions;
- Greater scrutiny of AML/CTF/CPF compliance frameworks and their effectiveness;
- Continued focus on governance, accountability, and risk management;
- Expanded regulatory reporting and data collection requirements; and
- Growing expectations regarding the implementation and monitoring of compliance controls.
Measures introduced under the Financial Intelligence Centre Act (FICA), including reporting obligations such as the Risk and Compliance Return (RCR), form part of a broader move towards more structured regulatory oversight and improved data collection.
Against this backdrop, the COFI Bill remains one of the most important regulatory developments on the horizon. Although not yet enacted, it is expected to introduce significant changes to South Africa’s conduct regulatory framework through a more outcomes-based and activity-driven approach to regulation and supervision.
This webinar will provide participants with a practical overview of recent regulatory developments and enforcement trends, while focusing in depth on the COFI framework, its progression through the legislative process, and its expected impact on financial institutions. Particular attention will be given to issues such as governance, accountability, customer outcomes, and ongoing disclosure obligations, as well as the steps firms can begin taking now to prepare for the evolving regulatory landscape.
